Live Energies GmbH take the protection of your personal data very seriously and want you to know when we collect which data and how we use it. Personal data is any information that can be used to identify you and can be traced back to you – for example, your name, address, e-mail address and telephone number.

Please note that the transmission of data via the Internet may be subject to security vulnerabilities. Full protection against access by third parties is not feasible.

Your rights as a person concerned

You can exercise the following rights at any time by contacting our data protection officer:

  • Information about your data stored by us and its subsequent processing (Art. 15 DSGVO),
  • Correction of incorrect personal data (Art. 16 DSGVO),
  • Deletion of your data stored by us (Art. 17 DSGVO),
  • Restriction of data processing if we are not yet allowed to delete your data due to legal obligations (Art. 18 DSGVO),
  • Objection to the processing of your data by us (Art. 21 DSGVO) and
  • Data portability, provided that you have consented to the data processing or have concluded a contract with us (Art. 20 DSGVO).
  • Right to revoke consent. As far as the processing of personal data is based on your consent (Article 6 par.1 (a) DS-GVO), you may revoke it at any time for the corresponding purpose with effect for the future. The lawfulness of the processing based on your consent granted remains unaffected until receipt of your revocation.

Collection of general information on visiting our website

When you access our website, general information is automatically collected. This information (server log files) includes, for example, the type of web browser, the operating system used, the domain name of your Internet service provider, your IP address and the like.

In particular, they are collected and processed for the following purposes:

  • Ensuring a trouble free connection of the website,
  • ensuring a smooth use of our website,
  • evaluating system security and stability, and
  • for the optimisation of our website.

We do not use your data to draw conclusions about your person. Information of this kind will only be statistically analysed anonymously, if necessary, in order to optimise our website and the technology behind it. The collected data will not be transferred to third countries.

The processing is carried out based on our legitimate interest in improving the stability and functionality of our website in accordance with Art. 6 para.1 (f) DSGVO.

Recipients of the data are technical service providers who are contracted to operate and maintain our website.

The data is deleted as soon as it is no longer required for the purpose for which it was collected. This is generally the case for the data used to provide the website when the respective session has ended. In the case of storage of data in log files, this is the case after 14 days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are anonymised, so that an assignment of the accessing client is no longer possible. To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g. SSL) via HTTPS.

There is no legal or contractual obligation to provide the aforementioned personal data. However, without the IP address, the service and functionality of our website is not guaranteed. In addition, individual features and services may not be available or may be limited. For this reason, an objection is excluded.

Use of technically necessary cookies

Our website uses technically necessary cookies. Cookies are text files that are stored in the Internet browser or by the Internet browser on the user’s computer system. When a user accesses a website, a cookie may be stored on the user’s operating system.

The cookie we set is necessary to make our website user-friendly. Some elements of our website require that the calling browser can be identified even after a page change. The cookie (pll language) is used to store and transmit language settings in order to maintain the language selected by the user. It remains stored for 1 year. The collected user data is not used to create user profiles and the information is not transmitted to third countries.  The legal basis for the processing of personal data using technically necessary cookies is Art. 6 para. 1 (f) DSGVO.

Processing of personal data in case of an inquiry or the like

If you contact us using the options offered by us, your contact data will be stored so that we can later use it to process and respond to your inquiry. In such cases, we process only those data that are necessary in order to assign the request and the subsequent response to the same and to properly document the action. This includes in particular those personal information (e.g. surname, first name, address, e-mail address, etc.) that we have received directly from you yourself, as well as the information provided by the contact channel you have chosen (letter, telephone, e-mail, business card). The processing of the data provided by you is based on a legitimate interest (Art. 6 para. 1 (f) DSGVO). If you contact us to request a quote, the processing of the data entered in the contact is carried out for the implementation of pre-contractual measures (Art. 6 para. 1 (b) DSGVO).

Recipients of the data are, if required, order processors. We will only pass on the data we receive from you to third parties if you have given your express consent or if we are obliged to do so by law or on the basis of a court decision. Submissions and inquiries in electronic or paper form are stored until they are no longer necessary for the purposes for which they were collected or otherwise processed. Data will be deleted no later than 6 months after the request has been processed. If a contractual relationship arises, we are subject to the statutory retention periods according to the German Commercial Code (HGB) and will delete your data after these periods have expired. The collected data will not be transferred to third countries.

The provision of your personal data is voluntary. However, we can only process your request if you provide us with your name, e-mail address and the reason for the request.

Changes to our privacy policy

We reserve the right to adapt this data protection declaration so that it always complies with the current legal requirements or in order to implement any changes of our services in the data protection declaration, e.g. in case of the introduction of new services. The new privacy policy will then apply to your next visit.

The privacy policy was created with the help of activeMind AG, the experts for ”externe Datenschutzbeauftragte“ (version #2020-09-30).
